Where For Art Thou, Senators Lautenberg & Menendez?

Yesterday I posted about which senators to target in the upcoming healthcare showdown. In addition, I mentioned that there were two State Work Periods coming up which, presumably, will mean that our senators will be back in New Jersey and available to their constituents.

This prompted me today to call Senator Lautenberg’s and Senator Menendez’ offices to see what their schedule and agenda was for these two breaks. Their answer? Neither office knows what the senators are doing. They don’t know if they are going to be in New Jersey, let alone if they have any events scheduled. Considering that the first break begins tomorrow, this seems a little suspicious to me (albeit not surprising). 

So, here we are with one of the most serious and important pieces of legislation to come before the Senate in our lifetimes and our two senators are MIA. They have no known plans for giving the people they represent a chance to speak with them about an issue that will impact their very lives before a potential vote in December. For all I know they will be on their way to St. Bart’s to console their fallen comrade, Governor Corzine.

Frankly, I think it’s time our two senators stopped hiding behind their desks. It’s time both of them showed some guts and faced their constituents.

AFP Faithful Descend On Lautenberg’s Office

Lautenberg's OfficeAs I mentioned yesterday, the AFP New Jersey contingent dropped by for a little chat on Friday with Senator Lautenberg. Although the Senator was back in New Jersey, we were able to meet with his spokesperson (I believe his name was Doug). To his credit, Doug was very professional and handled our questions and comments repectfully.

However, I had a chance before the meet-up ended to ask about the report I posted on earlier this week, regarding Harry Reid scheming to get a health care bill to the President’s desk by attaching it to a House bill that has nothing to do with health care.

I expected that I would hear from Doug that the report wasn’t true or that he knew nothing of it. Instead, though, he attempted to duck and dodge my question – for example, by saying 60 votes would still be needed, when that is only true of the vote to end a filibuster and not a vote on the final bill.

Further, when I pressed Doug to see if the Senator would oppose any effort by the Majority Leader in attaching the Senate bill to a non-healthcare House bill, he would not answer and provided no such commitment.

Unfortunately, the only conclusion I can draw from this is that the Senator knows of this effort and would not use his influence in the Senate to oppose it. Yes, I know…hardly shocking. Yet still, as we begin calling our legislators this week – AFP will be promoting a national drive to just that – on top of voicing your opposition to healthcare, be sure to contact Senator Lautenberg’s office and pressure him to put a stop to this underhanded approach to passing their agenda.

By the way, we should all be proud that our tax dollars pay for the Senator’s posh Washington office and LCD TV’s. How else would his staff be able to tune in to MSNBC while at work?

Lautenberg Gunning For Our Guns

Senator, Laut…err…Lousenberg is the primary sponsor of legislation to close a so-called “gun show loophole.” The bill would do the following:

The Senators’ bill would close the loophole by requiring background checks on all sales at gun shows. The bill defines a gun show as any event where 50 or more guns are offered or exhibited for sale. In addition, the bill would require:

  • gun show promoters to register with the Bureau of Alcohol, Tobacco and Firearms (ATF), maintain a list of vendors at all gun shows and ensure that all vendors acknowledge receipt of information about their legal obligations; and
  • federal Firearms Licensees (FFLs) to submit information, including the manufacturer/importer, model and serial number of firearms transferred at gun shows to the ATF’s National Tracing Center (NTC). No personal information about either the seller or the purchaser would be given to the ATF. Instead, as under current law, FFLs would maintain personal information in their files. The National Tracing Center would request personal information from an FFL only if a firearm becomes the subject of a law enforcement trace request.

In typical liberal style, Lousenberg used the events like the anniversary of the Columbine shootings and the Virginia Tech shootings to gin up emotion and support for his initiative.

With the anniversaries of the Virginia Tech massacre and Columbine shootings in the news, Sen. Frank Lautenberg will push again Tuesday to close the so-called gun show loophole that lets some gun sales go through without background checks of the buyers. In a statement to Whispers, Lautenberg said: “There is no rational reason to oppose closing the loophole. The reason it’s still not closed is simple: the continuing power of the special-interest gun lobby in Washington. My legislation would require background checks for every gun purchased at every gun show across America and would keep guns out of the hands of people who should not have them. Without this change in the law, anyone—from felons to fugitives—can buy a gun at a gun show, no questions asked. That needs to change.”

Interestingly, liberals like Lousenberg who push for anti-gun legislation don’t seem to be as interested in protecting us from criminals who cross our borders and commit violent crimes, let alone preventing terrorists from entering our country anywhere along our southern border (but I digress).

The Viriginia Tech killer, I might add, did not purchase his weapons at a gun show.

More to the point, however, the first thing to understand about this is exactly what is being referred to as a “loophole.” Wikipedia describes it as follows:

The “gun show loophole” is a term coined by gun control advocates to describe the legal sale of firearms between private individuals at gun shows in states where this is legal. When these sales take place at a gun show, some perceive a “loophole” in the National Instant Criminal Background Check System (NICS), although these laws have never applied to individual-to-individual sales of personal firearms. United States federal law requires persons engaged in interstate firearm commerce, or who are in the business of selling firearms, to hold a Federal Firearms License and to perform checks prior to transferring a firearm, but there is an exemption for private sales by individuals who are “not engaged in the business” of selling firearms, or who only make “occasional” sales. Unlicensed private sellers are permitted by law to sell privately-owned guns at gun shows, or at any other location, in 24 states (as of 1998).[9]

Senator Lousenberg and his anti-gun partners would like to have us believe that dealers are somehow skirting the law, but this is simply not the case. The law just does not require private individuals to have a license. And any dealer who tried to sell a firearm without a license would immediately be arrested and prosecuted.

Furthermore, very few of these private transactions actually even occur at gun shows. In an article by David Kopel of the Cato Institute, David explains:

Conversely, people who are not engaged in the business of selling firearms, but who sell firearms from time to time (such as a man who sells a hunting rifle to his brother-in-law), are not required to obtain the federal license required of gun dealers or to call the FBI before completing the sale.

Similarly, if a gun collector dies and his widow wants to sell the guns, she does not need a federal firearms license because she is just selling off inherited property and is not “engaged in the business.” And if the widow doesn’t want to sell her deceased husband’s guns by taking out a classified ad in the newspaper, it is lawful for her to rent a table at a gun show and sell the entire collection.

If you walk along the aisles at any gun show, you will find that the overwhelming majority of guns offered for sale are from federally licensed dealers. Guns sold by private individuals (such as gun collectors getting rid of a gun or two over the the weekend) are the distinct minority.

Yet HCI claims that “25-50 percent of the vendors at most gun shows are unlicensed dealers.” That statistic is true only if one counts vendors who aren’t selling guns (e.g., vendors who are selling books, clothing or accessories) as “unlicensed dealers.”

David’s last point is likewise quite important. Lousenberg has used the 25-50 percent statistic in his efforts to sell this bill. But he is clearly being disingenuous in this respect because, as Mr. Kopel points out, many of the vendors at gun shows are not selling guns.

Last but not least, very few gun crimes – a mere 2% in fact – are committed using firearms purchased at gun shows. Again, via Wikipedia:

A 1997 Department of Justice survey of 3,959 prison inmates found that only 2% stated that they had bought a gun used in a crime from a gun show.[10] The remaining 98% were obtained from other sources, in which the criminal had no direct connection with a gun show. The most common sources (35%) were family or friends.[11]

Considering the facts I have outlined, it is difficult not to conclude that this is just another effort by the left-wing to infringe on the right to bear arms and an utterly misguided attempt prevent gun crimes. Even if enacted, this legislation would do little if anything in this respect. But what it would do is set the stage for the next incremental step to prevent law-abiding citizens from exercising their 2nd Amendment rights.

Americans deserve an honest and truthful debate about gun issues, not the kind of demagoguery being put forth by the likes of Senator Lousenberg.

Top NJ Dems In Possible Lobbying Scandal

A number of top Democrat lawmakers have been named in a potential scandal involving ReGen Biologics. ReGen is the maker of a knee implant device which was twice rejected by the FDA. Subsequently, the firm started to line the pockets of several Democrats including Sen. Lautenberg, Sen. Menendez, Rep. Rothman and Rep. Pallone. The lobbyist hired by the firm, Michael Hutton, used to be Sen. Menendez’ chief of staff. In December of 2008, the FDA approved ReGen’s knee implant device. Here’s the full story.

Executives of a small medical-device company donated $50,000 in the 2008 election campaign to New Jersey Democrats who went to bat for the company’s knee implant at the Food and Drug Administration, according to campaign donation records.

Three top executives of ReGen Biologics Inc., based in Hackensack, N.J., began the donations in the fall of 2007, about a month after the FDA’s second rejection of the medical device. The three together made only two other political donations totaling $6,000 this decade, according to the Center for Responsive Politics, a nonpartisan watchdog group.

The New Jersey recipients were Sen. Robert Menendez, Sen. Frank Lautenberg, Rep. Frank Pallone and Rep. Steve Rothman, as well as related political action committees. Rep. Pallone is chairman of the Health Subcommittee of the House Energy and Commerce Committee, which oversees the FDA. Sen. Menendez, who was not up for re-election in 2008, received $18,300, the highest sum.

ReGen spent $200,000 on lobbyist Michael Hutton, Sen. Menendez’s former chief of staff, according to House records. It didn’t retain lobbyists before 2007, the records show.

The New Jersey Democrats began pressing then-FDA Commissioner Andrew von Eschenbach to become involved in the ReGen case in late 2007. Three of the lawmakers sent Dr. von Eschenbach a letter, and Sen. Menendez called the commissioner, according to ReGen’s lobbyist.

Through 2008, ReGen’s executives strove to get the FDA to approve the knee-surgery device called Menaflex. In October 2008, an aide to Rep. Pallone called FDA officials to discuss ReGen’s desire for input on the membership and agenda of an agency advisory panel, according to an internal FDA memo. The FDA’s top device regulator cleared Menaflex in December 2008.

ReGen said through a spokeswoman that it turned to politicians to prevent FDA scientists from applying what the company considered illegal standards of safety and efficacy. “In contacting members of Congress, ReGen’s goal was to obtain fair process and a timely decision” at the FDA, the spokeswoman said. She declined to comment about the donations.

All four New Jersey politicians have said through representatives that their involvement in the ReGen case was aimed at ensuring the company received fair treatment at the FDA.

ReGen Chief Executive Gerald Bisbee and his wife, who live in Connecticut, contributed $32,100 to the New Jersey candidates and the Democratic Senatorial Campaign Committee between October 2007 and October 2008. John Dichiara, ReGen’s government-relations director, gave $20,800. The company’s chief financial officer contributed $2,500 to Mr. Menendez.

The approval of Menaflex is under investigation in the Senate Finance Committee. In addition, Rep. Michael Burgess (R., Texas) has asked the House Energy and Commerce Committee’s investigations panel to review it.

“I am particularly troubled by the allegations” that normal procedures weren’t followed in the FDA’s approval process, Rep. Burgess wrote in a letter to Rep. Bart Stupak (D., Mich.), head of that panel. Mr. Burgess cited FDA documents in ReGen’s case.

Corruption or typical Washington politics? Hopefully, a full and open investigation will unveil the truth.

By the way, next time these Democrats publicly complain about special interests and how they are destroying our country be sure to remember this story.

Not surprisingly, the mainstream media has been largely ignoring these protests, but it will be hard to ignore on April 15th when thousands of us will be marching in cities all over the country at the same time. So, get out there and join the movement!

Jennifer Granholm: Opposing Auto Bailout Makes You “Un-American”

This is just remarkable. Michigan Governor Jennifer Granholm, in the wake of the Senate defeat of the auto industry UAW bailout, accused those who opposed the measure of being ”un-American.” 

“It is unacceptable for this un-American, frankly, behavior of these U.S. senators to cause this country to go from a recession into a depression,” Granholm said during a radio interview Friday morning.

Imagine someone accused Granholm of doing the very same thing on this or any other issue? There would be an uproar on the Left.

Later in the day, Granholm went on to accuse those Senators who opposed the bailout of favoring foreign automakers.

This is chutzpah of the tallest order considering it is people like Granholm who have helped cause the problem. It is Granholm and other liberal Democrats who have made it impossible for the US automakers to succeed by virtue of a) being in bed with the UAW and not compelling them to make concessions and b) their continual support of crushing regulations and environmental standards.

Liberals like Granholm are the ones who have actually - in a roundabout way - showed favoritism to foreign automakers. They’ve created an economic environment where it’s harder for the Big 3 to be profitable, while companies like Honda are not subject to the same pressures.

Is it any wonder that Granholm’s home state of Michigan is an economic disaster?
