AFP Faithful Descend On Lautenberg’s Office

Lautenberg's OfficeAs I mentioned yesterday, the AFP New Jersey contingent dropped by for a little chat on Friday with Senator Lautenberg. Although the Senator was back in New Jersey, we were able to meet with his spokesperson (I believe his name was Doug). To his credit, Doug was very professional and handled our questions and comments repectfully.

However, I had a chance before the meet-up ended to ask about the report I posted on earlier this week, regarding Harry Reid scheming to get a health care bill to the President’s desk by attaching it to a House bill that has nothing to do with health care.

I expected that I would hear from Doug that the report wasn’t true or that he knew nothing of it. Instead, though, he attempted to duck and dodge my question – for example, by saying 60 votes would still be needed, when that is only true of the vote to end a filibuster and not a vote on the final bill.

Further, when I pressed Doug to see if the Senator would oppose any effort by the Majority Leader in attaching the Senate bill to a non-healthcare House bill, he would not answer and provided no such commitment.

Unfortunately, the only conclusion I can draw from this is that the Senator knows of this effort and would not use his influence in the Senate to oppose it. Yes, I know…hardly shocking. Yet still, as we begin calling our legislators this week – AFP will be promoting a national drive to just that – on top of voicing your opposition to healthcare, be sure to contact Senator Lautenberg’s office and pressure him to put a stop to this underhanded approach to passing their agenda.

By the way, we should all be proud that our tax dollars pay for the Senator’s posh Washington office and LCD TV’s. How else would his staff be able to tune in to MSNBC while at work?

NJ Protesters Sound Off At Obama Rally

A New Jersey contingent joined a crowd of several hundred sign-waving protesters outside the Capitol in Washington on Friday to oppose changes the Obama administration wants to make to health insurance and much more.

“We’re just really concerned about basically our liberty being taken away,” said Mike Proto of Hackensack, holding a sign reading “Socialism Isn’t Cool.”

Along with health care, Proto cited the proposals to reduce carbon emissions through a cap-and-trade system as job killers that would infringe on personal liberty.

The rally was organized by the group Americans for Prosperity as part of its two-day “Defending the Dream” summit.

Proto’s sign and the hundreds reading “Hands Off My Health Care,” were printed by AFP, but many people also held hand-lettered signs with such slogans as “King George Didn’t Listen Either” and “Obamacare/The Next Cash for Clunkers/Turn in Grandma.”

“The government is mandating that we all get health care and if we don’t we all get fined. I don’t think that’s right,” said George Humphris of Toms River. His elaborate, homemade sign attracted many in the crowd who wanted a snapshot of it.

Live Blogging The Defending The American Dream Summit

{3:15} We are in the ‘breakout’ period right now where there are several discussion/panels going on at one time. I attended a panel on business and job growth issues which touched on things like our regulatory state, this misnamed ‘Freedom of Choice Act’ (card check), and pensions. Some tidbits from this session:

  • Even if we strip away all the bad legislation currently before us (healthcare, cap and trade), we will have a TRILLION dollar regulatory state in place which is stifling job growth
  • The worst regulations – the ones we need to watch most – are environmental and occupational regulations
  • The regulatory state is killing small business, which accounts for 2/3rd of America’s jobs
  • Since the passage of the Porkulus bill, 27 MILLION jobs have been lost (and we now know that the unemployment rate is 9.8%, well past the cap of 8% ‘promised by Obama)
  • If the FOCA were to pass, we can expect 600,000 jobs to be lost in year one (although the speaker expected FOCA would not pass)
  • Multiple Employer Pensions - If, for example, 5 companies are pooled into the same pension fund and, say, 4 go out of business the remaining company would be on the hook to pay the pensions of the others who four that are defunct. In such a scenario, the remaining company would likely decide to just fold up shop.

  • Newt laid out a REAL stimulus plan for America: 1) A 2 year, 50% reduction in the Social Security and Medicare tax – “people would actually see how much they pay in taxes,” he said; 2) Match the Chinese capital gains tax which is…ZERO!; 3) Match the Irish coroporate tax rate of 12.5%; 4) Permanently abolish the death tax – “people shouldn’t be punished when they die.”
  • Other quotables: The Speaker said we need “an American energy policy from American sources” and “bowing to a Saudi king is not an energy policy!”
  • “We can balance the federal budget because in 4 years when I was Speaker we balanced the budget”

Yesterday we arrived at around noon and headed directly to the Capitol steps for a rally and a surprise visit to the offices of Senator Lautenberg. In the evening, we were treated to a number of terrific speakers, highlighted by Congressman Mike Pence and Laura Ingraham. Laura gave a fun and inspiring speech, fitting of the wit she displays daily on her radio show. There is a lot of energy among the AFP members and a clear determination to continue opposing the radical agenda coming from this White House and Congress.

In a few moments, we will have our first speaker of the day, and fittingly that will be Speaker Gingrich. So, keep checking in for updates!

2009 Defending The American Dream Summit

2009-summit-image.jpgOn Friday and Saturday, I’ll be privileged to be attending the 3rd annual Defending The American Dream Summit, held by Americans for Prosperity. The 2-day event will include guest speakers such as Laura Ingraham, John Fund, Larry Kudlow, Newt Gingrich and more. The Summit could not come at a more crucial time, with Congress poised to ram through both healthcare and Cap & Trade legislation. In addition to holding a rally at the Capitol, our New Jersey contingent will also be knocking on the door of Sens. Lautenberg and Menendez to voice our opposition to these two horrible and destructive measures.

New Jersey citizens urge Corzine to reduce spending, reject stimulus money

Join AFP-NJ along with grassroots activists across the country on April 15th at 5PM for a Taxpayer Tea Party to protest Governor Corzine’s proposed tax hikes.

NJ has the worst tax climate in the nation, and yet Governor Corzine continues to rely on tax revenues to support the state’s overgrown budget. This tradition has left us poorly positioned to deal with the economic recession.

Even with the so-called stimulus funds that are coming to New Jersey– totaling $2 billion– Governor Corzine has introduced a FY 2010 state budget with a $7 billion deficit, and massive tax hikes to go along with it.

Not surprisingly, the mainstream media has been largely ignoring these protests, but it will be hard to ignore on April 15th when thousands of us will be marching in cities all over the country at the same time. So, get out there and join the movement!

New Jersey’s Runaway Supreme Court

New Jersey’s fiscal woes are not only to be placed at the feet of Corzine, McGreevey and the state’s legislature (as well as Governor Whitman I might add). It should be noted that New Jersey also has a runaway Supreme Court which has time and again overstepped its constitutional authority and legislated from the bench.

Two of the Court’s most egregious decisions were handed down in what is known now as Lonegan I and Lonegan II. In those cases the NJ Supreme Court essentially turned the New Jersey constitution on its head and green-lighted runaway spending by the Governor and state legislature.

Here, Steve Lonegan summarizes the sequence of events and alerts New Jerseyans that it will likely take another law suit to undo the damage the court has unleashed on New Jersey taxpayers.

Just over five years ago, the New Jersey Supreme Court decided on two of the most important cases in the state’s fiscal history– Lonegan vs. State I 174 NJ 435 (2002) and Lonegan vs. State II  176 NJ 2 (2003).

A disappointing loss in Lonegan I allowed Republican Governor Whitman’s plan to borrow $8.6 billion without voter approval to construct schools in 28 urban districts as ordered by the Supreme Court in Abbot vs. Burke. The Supreme Court would not allow voters to reject something it had mandated, no matter how costly or destructive.

But the court claimed it was troubled by the method used to borrow money without voter approval as required by Article VIII of the NJ Constitution.  A “shell entity,” also known as a straw man, the NJ Economic Development Authority, issued bonds to borrow the money—even though it had no income. Then the state made contracts to pay all obligations on those bonds with tax revenues for the next 30 years. The problem is that there is no guarantee that future payments will be made. These annual payments are subject to approval by the legislature and conceivably can be voted down. Most purchasers of this contract debt are not aware of this risk, but investment firms continue to sell these bonds as if they are risk free.

Supreme Court Justice Stein, writing in 2002, was alarmed that this gimmick had been used to borrow $10.8 billion, 75 percent of the state’s bonded debt, without voter approval. He urged the Court to agree with my assertion and end the practice.

But the Supreme Court delayed that part of the decision until after Justice Stein, clearly sympath et ic to my case, had reached the mandatory retirement age, and was replaced by Justice Albin, appointed by Governor McGreevey.

In Lonegan II, the Supreme Court in a heart breaking 4-3 decision approved all state borrowing for any purpose without voter approval—as long as a shell entity did the borrowing without pledging the full faith and credit of the state. In essence, the State Supreme Court is complicit in what could be the largest consumer fraud scheme by any state in the country-selling bonds as if they have been approved by voters.

The result has been an absolute financial catastrophe for New Jersey.  In his 2008 State of the State Address, Corzine blamed Supreme Court decisions for “the sharp deterioration of our State’s finances,” which included $32 billion in bonded debt, only $3 billion of which was approved by voters. I agree with the Governor’s statements. But Governor Corzine’s actions do not follow his words.  Six months after criticizing New Jersey ’s “credit card culture” that ignored our Constitution, Governor Corzine approved using the old gimmicks to borrow $3.9 billion more without voter approval.

There are other reasons to reconsider and overrule the previous Lonegan decisions. First, Lonegan II relied on bad history.  It claimed that New Jersey’s 1844  Constitution, which first  required voter approval of new state debt, was framed to prevent states from defaulting on debts backed by the “full faith and credit” of taxpayers.

However, many scholars today, like University of Maryland Professor of Economic History John Joseph Wallis, take a different view.  They suggest that the 1844 framers wanted to end “systematic corruption” where politicians had too many opportunities to get bribes and political support by favoring some businesses at the expense of others. The framers of 1844 reduced those opportunities by requiring voter approval of new state debt.  Other reforms in that 1844 Constitution time included uniform laws that took the politics out of forming new corporations and local governments.

Second, Lonegan II put way too much faith in Wall Street .

“(T)he state has responded to changes in the financial markets that reflect modern economic realities…yesterday’s speculation has become ‘sound and economical current business practice. . . “ Lonegan, supra, 176 NJ at 14.

In his October 23, 2008 testimony to Congress, Federal Reserve Chairman Alan Greenspan showed the framers of New Jersey’s Constitution to be far more reliable than today’s Wall Street “geniuses.”

“In recent decades, a vast risk management and pricing system has evolved, combining the best insights of mathematicians and finance experts. . .  The whole intellectual edifice, however, collapsed in the summer of last year because the data inputted into the risk management models generally covered only the past two decades, a period of euphoria. . .”

Finally, last November 4, 2008, New Jersey voters approved amendments to Article VIII of New Jersey’s Constitution which prohibits this type of borrowing without voter approval. But this case is far from moot. The Amendment only applies to future borrowing.

Also, the new Amendment has this troublesome language, which did not appear in the ballot question:

“No voter approval shall be required for. . . refinancing of all or a portion of any outstanding debts or liabilities of. . . an autonomous public corporate entity…”

Does that mean the state can refinance NJ’s $29 billion of old “contract debt” with new debt backed by the full faith and credit of the state—without voter approval?    Future litigation may be needed to decide that issue.   But in the meantime, there are many reasons to reconsider and reverse Lonegan I and Lonegan II, and the future fiscal health of New Jersey will rest on this decision.

EPA Moves To Regulate Our Entire Way Of Life

The EPA is asking for public comments on its intention to regulate greenhouse gas emissions under the Clean Air Act, something the Act was never designed to do.  We need your voice to be heard.

Over the past year, AFP has been warning you about global warming alarmism and the environmental political correctness that it has spawned.  One of the greatest dangers this alarmism presents is the continued rise of unelected bureaucrats and their attempts to grab power from the people.  The proposed regulation by the EPA is a clear example of the regulations this panic will produce.

After the Senate rejected a plan to regulate greenhouse gases, the EPA decided to go ahead and do it anyway.  The extent of their plan is truly terrifying.  If this proposal becomes law, 33 programs within the EPA would be empowered to, among other things:

•    Impose Grass Mileage Standards for Home Lawnmowers
•    Put Speed Limiters on the Commercial Trucking Fleet
•    List Large Single-Family Homes as Carbon-Polluters
•    Require Carbon Permits for Retail, Restaurant, Hotel and School Construction
